Application of the principle of legality, right to a fair trial and other protected rights in core international crimes cases
This report outlines the most prominent cases in which the European Court of Human Rights evaluated the application of Article 7 of the European Convention on Human Rights (ECHR). Article 7 provides that ‘no one shall be held guilty of any criminal offence on account of any act or omission which did not constitute a criminal offence under national or international law at the time when it was committed’.
Digital Information Exchange in Terrorism Cases
On 31 October 2023, an amendment of the Eurojust Regulation entered into force, enhancing Eurojust’s ability to identify links between terrorism investigations and prosecutions, to establish a modern Case Management System, to provide a secure digital communication channel between Member States and Eurojust, and to facilitate cooperation with third countries. This document, which is updated biannually, provides an overview of the case-law of the Court of Justice of the European Union (CJEU) with regard to the application of Framework Decision 2002/584/JHA of 13 June 2002 on the European Arrest Warrant (EAW) and the surrender procedures between Member States (EAW FD).
